EFFECTIVE IMMEDIATELY: All secured creditors, including mortgage creditors, must be paid through the plan as part of the plan payment to the Chapter 13 Trustee. The only exception will be if a Debtor is current with a secured creditor, they may file a separate motion asking the court to allow them to make direct payments to that creditor. If the court allows the Debtor to make direct payments, the stay will be lifted as to that property and creditor, and that property will no longer have any bankruptcy court protection. This policy change is at the direction of all of the Judges in the Tampa & Fort Myers Divisions of the United States Bankruptcy Court Middle District of Florida.

What We Do:
The Office of Jon M. Waage, Standing Chapter 13 Trustee for the Middle District of Florida, administers chapter 13 bankruptcy cases in the Tampa and Fort Myers Divisions. Matters are heard before Judge Alexander L. Paskay and Judge Catherine Peek McEwen. We administer bankruptcy cases under the supervision of the United States Trustee and act as a clearinghouse, to receive and disburse funds exactly as prescribed by orders of the court.
